Filing an L1 Application in Ontario: Key Considerations for Landlords

If you’re a landlord dealing with non-payment of rent, the L1 Application to the Landlord and Tenant Board (LTB) is the legal tool used to request termination of the tenancy and recover the rent owed. However, successfully navigating this process requires attention to detail and full compliance with the Residential Tenancies Act, 2006 (RTA).
Here are some essential considerations when preparing and filing an L1 Application:
- Serve the N4 Notice Properly
Under section 59(1) of the RTA, landlords must first serve an N4 Notice to End Tenancy for Nonpayment of Rent before filing an L1. This notice must be completed accurately, include a proper termination date, and be served using a method permitted under section 191 of Regulation 516/06. - Ensure Rent Amounts Are Accurate and Well-Documented
The LTB requires a clear statement of the rent arrears being claimed. Including a rent ledger and, where possible, a copy of the tenancy agreement will strengthen your application. Tenants have a right to dispute the amount owed under section 82 of the RTA. - File After the Termination Date
An L1 application can only be filed after the termination date in the N4 notice has passed (section 59(3)). Filing too early may result in administrative delays or dismissal. - Understand How Payments Affect the Process
If the tenant pays the full arrears before the N4 termination date, the notice becomes void (section 59(4)). Landlords must take care to assess any payments received during the notice period before proceeding with an L1. - Include All Required Attachments
Supporting documentation such as a copy of the N4, Certificate of Service, rent history, and lease helps demonstrate the legitimacy of your claim and is encouraged under LTB Rules of Procedure, Section 185.
