Affidavit of Title or Affidavit of No Lien

In Ontario, an Affidavit of Title or Affidavit of No Lien is an important legal document used in real estate transactions to confirm ownership and provide assurances regarding the state of title to a property. This document is crucial in the process of buying and selling a property as it is a sworn declaration affirming that there are no Liens or disputes or any legal issues with the property. When you bring your non-signed Affidavit of Title to our office it should be completed and contain information such as the name and address of the affiant and the connection to the property. Moreover, the Affidavit of Title has to contain a description of the property such as the address and legal description of dimensions. The affidavit also requires a statement affirming the property is not subject to any liens, mortgage, or encumbrance.

Supporting documentation is as follows: Property records, title Deeds, and receipts of any payments such as Lien settlements or mortgage payments. To avoid any mistakes, you have to ensure that all the documents are fully disclosed and there is no incomplete information or discrepancies between documents so the notary public can identify and authenticate them.
